2017 Session

The 2017 Legislative session included numerous bills related to criminal justice reform. The legislature requested fiscal impact statements on numerous instruments. While the Legislature was unable to agree on state funding during the regular session, LPDB ultimately received an appropriation amounting to essentially a standstill budget for the upcoming fiscal year.
HB 1/ Act 3 of the Second Extraordinary Session (Representative Henry): The Legislature appropriated $33,995,091 to the Louisiana Public Defender Board through its Public Defender Fund, Indigent Parent Representation Program Fund, and DNA Testing-Post Conviction Relief for Indigents Fund.

HB 249/ Act 260 (Representative Magee): Passed as part of the criminal justice reform package, this act judicial determination of an offender’s ability to any fines and fees imposed upon sentencing and authorizes the court ro waive, modify, or create a payment plan for the offender’s financial obligations.

SB 16/ Act 277 (Senator Claitor): Passed to address the Supreme Court’s decision in Montgomery v. Louisiana that Life without parole for juvenile offenders should be reserved for the “worst of the worst”. All offenders convicted of first or second degree murder prior to August 1, 2017, and who were under the age of 18 at the time of the crime, would become parole eligible after 25 years unless the district attorney were to file a notice of intent to seek a sentence 0f life imprisonment without the possibility of within ninety days of August 1, 2017.

SB 221/ Act 282 (Senator Alario): Passed as part of the criminal justice reform package, this act reduces the cleansing period for the habitual offender statute from 10 to 5 years, and reduces the maximum sentences that may be imposed when convicted under the habitual offender statute.
